Intellectual Property Law

Most businesses hold more intellectual property than they have formally protected. We advise on identifying what is protectable, securing it through the Kenya Industrial Property Institute and the Kenya Copyright Board, and putting in place the licensing and assignment arrangements that let it be used commercially.

IP is often the most valuable thing a business owns and the least formally protected — a brand name in use for years with no registered trademark, or software built by a contractor with no assignment of rights. We start by identifying what you actually have, then put the registrations and agreements in place to secure it.

Trademarks, copyright, designs and licensing — from registration through to enforcement.

What We Do

Our work in intellectual property law typically covers:

  • Trademark searches, filing and prosecution — Clearance searches and filing at KIPI, through to registration.
  • Oppositions and rectification — Defending or challenging trademark applications and registrations.
  • Industrial designs and utility models — Protecting product shapes, packaging and functional innovations.
  • Copyright registration and assignment — Registering works with the Kenya Copyright Board and documenting ownership transfers.
  • Licensing, franchising and distribution of IP — Structuring how your IP is used commercially by others.
  • IP audits and portfolio management — Reviewing what IP a business holds and where the gaps are.
  • Confidentiality and trade secret protection — NDAs and internal policies protecting information that isn't registrable.
  • Infringement and enforcement — Responding to and pursuing infringement, from cease-and-desist through to litigation referral.

Our Approach

  • 1. Initial consultation — We discuss your matter, understand what you need, and tell you plainly where you stand.
  • 2. Scope and fee agreement — We agree the scope of work and the fee basis in writing before work begins.
  • 3. The work — We handle the matter directly, keeping you informed at each material step.
  • 4. Completion and follow-up — We confirm the matter is complete and remain available for anything that follows from it.

Who We Act For

We act for businesses whose brand, content or technology is central to their value:

  • Consumer brands protecting their name and packaging
  • Media and creative businesses licensing content
  • Technology companies protecting software and platforms
  • Franchisors expanding into Kenya
